Australia/Japan Cross-border Estate Planning and Japanese Inheritance Tax

Following a very successful event on a similar topic in English last year, AJS-NSW is happy to support the following seminar in Japanese, aimed at people who need to understand the implications of Japan's inheritance and gift taxes.

It is a rare privilege to have Japanese inheritance tax specialists visit Australia and deliver a presentation. Don’t miss this event!

It is more common than ever for people to have assets in multiple countries. For those with assets in Japan and Australia, the differences in succession laws between the two countries may cause undue stress to family and friends if they pass away without carefully planning for cross-border estate management.

In particular, it is critical to be aware of Japan’s draconian inheritance tax and gift tax, which can even apply to assets or recipients in Australia.

There will be three speakers for this seminar:

  • Dai Ueda, senior associate at H & H Lawyers (Sydney). He will cover the basics of succession planning and inheritance procedures in Australia involving  Japanese beneficiaries.
  • Ken Takahashi, partner bengoshi at Kensei Law Office (Kyoto). He will speak about inheritance law implications and effective succession planning from a Japanese perspective, including how Japanese laws may affect someone in Australia.
  • Hiroshi Azuma, senior manager at zeirishi-hojin Yamada and Partners (Fukuoka), and an expert in Japanese inheritance tax and estate planning. He will speak about the complexities of Japanese tax regulations in the context of cross-border inheritance and how one might successfully navigate it.

SPEAKER BIOS

Dai Ueda was born in Niigata, Japan. He migrated to Australia and graduated from Macquarie University and then later from the University of New South Wales in law. At H&H Lawyers, he has gained years of experience in a variety of matters – corporate law, employment law, succession law, family law etc. – many of which have Japan/Australia multi-jurisdictional flavours.

Ken Takahashi focuses on corporate legal affairs, including legal advisory services and support for international transactions (such as drafting English-language contracts and assisting with overseas business expansion). He also actively handles international inheritance law for individuals, with particular expertise in Japanese-Australian will and inheritance matters.

Hiroshi Azuma joined the firm, Yamada and Partners in 2005. After gaining experience in inheritance and corporate tax services in Japan, he was stationed in Singapore and the Philippines from 2014 to 2018. After studying in the U.S. and returning to Japan, he has been working at the Fukuoka office since 2023, where he is involved in a wide range of tax services, including M&A and inheritance planning support for wealthy Japanese individuals.
